Terms of Service
1. Acceptance of Terms
By creating an account, subscribing, clicking “I agree,” accessing, or otherwise using Hyper Terminal, Hyper Stocks, Hyper Wealth, or any related websites, communities, content, tools, or services (collectively, the “Service”), you agree to these Terms of Service and to our Privacy Policy, Risk Disclosure, Subscription Terms, AI Disclaimer, and Market Data Disclaimer.
If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. You agree that all information you provide is accurate, current, and complete.
3. Nature of the Service — Research and Education Only
Hyper Terminal, Hyper Stocks, and Hyper Wealth provide general market research, educational content, data tools, market commentary, Market Notes, community content, and AI-assisted summaries only.
Nothing on the Service is personalized investment advice, financial planning, tax advice, legal advice, brokerage advice, or a recommendation to buy, sell, short, enter, exit, hold, or otherwise transact in any security, strategy, or financial instrument.
The Service does not consider your personal financial situation, investment objectives, risk tolerance, account size, time horizon, tax situation, or financial needs.
No adviser-client, fiduciary, brokerage, planner-client, or other professional relationship is created by your use of the Service.
Research ratings, setup labels, key levels, sector confirmation, scanner results, AI summaries, calendar data, Market Notes, Weekly Watchlists, Weekly Market Updates, and any similar output are general research and educational tools intended to help you form your own views.
They are not personalized recommendations, trade alerts, buy/sell signals, portfolio advice, or guaranteed outcomes.
You are solely responsible for evaluating all information, conducting your own due diligence, and deciding whether any security, strategy, or risk is appropriate for you.
4. Subscription Billing
Paid plans renew automatically on a recurring basis at the price and billing interval disclosed at checkout until you cancel.
By purchasing a paid plan, you authorize Hyper Stocks and its payment processor, Stripe, to charge your selected payment method on a recurring basis until you cancel.
Payment is processed by Stripe. Hyper Stocks does not store full credit card numbers.
Free accounts may generate a limited number of Ticker Reads, currently 5 per day. Access to additional features requires a paid plan.
You may cancel at any time from your account billing portal. Access continues through the end of the current paid period unless otherwise stated.
You are responsible for canceling before your next billing date if you do not want to be charged for the next period.
Refund handling is described in the Refund Policy.
We may change plan features, usage limits, or pricing with notice as required by applicable law. Price changes will not take effect until your next renewal period unless otherwise disclosed.
5. Trading and Investing Risk
Trading and investing involve substantial risk, including the possible loss of capital. You may lose some or all of the money you invest.
Losses can exceed your expectations, and certain financial products or strategies may involve risk beyond your initial capital.
Past performance does not indicate future results.
No research tool, rating, scanner, AI summary, watchlist, Market Note, or market commentary can eliminate risk or guarantee any result.
You are solely responsible for your investment decisions and for evaluating whether any research is appropriate for your situation.

6. AI-Generated Content
The Service may use AI to summarize structured market data, company data, platform-generated metrics, Market Notes, and research context.
AI output may be incomplete, delayed, inaccurate, or based on incomplete data.
AI does not know your personal financial situation and does not provide personalized financial advice.
AI-generated content may misinterpret data, omit relevant information, or produce inaccurate summaries. You should independently verify important information before relying on it.
AI outputs do not create an adviser-client, fiduciary, brokerage, or professional relationship.

7. Market Data
Market data comes from third-party providers, including Finnhub where applicable, and may be delayed, incomplete, inaccurate, or unavailable.
Third-party data providers retain ownership of their respective data.
We do not guarantee the accuracy, completeness, timeliness, or continued availability of any third-party data.
You may not copy, scrape, export, redistribute, resell, sublicense, or provide automated access to market data, derived data, research outputs, scanner results, or AI summaries except as expressly permitted by the Service.

8. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. User accounts are authenticated through third-party infrastructure, and you remain responsible for protecting your login credentials.
You may not share your login credentials or allow multiple users to access the Service through one account.
Notify us immediately at q@hyperstocks.io if you suspect unauthorized access.
We may suspend or restrict access if we believe your account has been compromised, shared, misused, or used in violation of these Terms.
8a. Third-Party Infrastructure and Service Providers
The Service relies on third-party providers for hosting, authentication, database storage, payments, email delivery, market data, AI infrastructure, analytics, security, and related operations. These providers may include Lovable Cloud, Supabase, Stripe, Klaviyo, Finnhub, AI model providers, and other vendors we use to operate the Service.
Your use of the Service may involve processing of information by these providers as described in our Privacy Policy. We are not responsible for third-party outages, delays, errors, data interruptions, or service limitations outside our reasonable control.
8b. Privacy
Our collection, use, storage, and sharing of information is described in the Privacy Policy.
9. Prohibited Use
You may not:
(a) redistribute, resell, sublicense, or automate access to the Service or its data, research outputs, scanner results, or AI summaries;
(b) reverse engineer or attempt to derive source data, rating methodologies, scanner logic, or platform systems;
(c) use the Service to violate applicable law or third-party rights;
(d) upload malicious, harmful, unlawful, abusive, or infringing content;
(e) share login credentials or allow multiple users to access the Service through one account;
(f) scrape, crawl, harvest, export, or bulk download data or content;
(g) use the Service to build, train, or improve a competing product, AI model, dataset, database, or service;
(h) use the Service for unlawful market manipulation, fraud, spam, misleading promotional activity, or illegal conduct.
10. Intellectual Property
The Service and all associated content, organization, design, branding, research frameworks, rating methodologies, scanner logic, templates, platform-generated presentation layers, and the Hyper Stocks, Hyper Terminal, and Hyper Wealth names, logos, and branding are owned by Hyper Stocks or its licensors.
Third-party market data remains owned by the applicable data providers.
We grant you a limited, non-transferable, revocable license to use the Service for your personal, non-commercial research use during a valid subscription or permitted free access period.
You may not copy, reproduce, distribute, resell, modify, create derivative products from, or exploit any part of the Service except as expressly allowed by these Terms.
11. Community, Telegram, and Market Notes
Community discussions, Telegram posts, Market Notes, Weekly Watchlists, Weekly Market Updates, stock analysis posts, and user comments are for general research and education only.
They are not personalized financial advice, trade alerts, buy/sell signals, portfolio advice, or recommendations to enter or exit any position.
You are responsible for your own decisions and should not rely on community content as the sole basis for trading or investing.
We may moderate, remove, restrict, or disable community access for conduct that violates these Terms or creates legal, security, or business risk.
12. Beta and Early Access
Some features may be offered in beta or early-access form.
Beta and early-access features may be incomplete, changed, limited, interrupted, or discontinued at any time.
Beta features may contain errors and should not be relied upon as the sole basis for any trading or investing decision.
13. User Content
You are responsible for content you submit to the Service, including comments, messages, feedback, or community posts.
You may not submit unlawful, misleading, defamatory, abusive, promotional, spam, infringing, confidential, or otherwise inappropriate content.
By submitting content, you grant Hyper Stocks a limited license to use, display, store, reproduce, and process that content as necessary to operate, moderate, and improve the Service.
14. Third-Party Links and Services
The Service may link to third-party websites, platforms, data providers, brokerages, payment processors, communities, or tools.
We are not responsible for third-party content, policies, data, availability, accuracy, services, or practices.
Your use of third-party services may be governed by their own terms and privacy policies.
15. Service Availability
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.
Features may be changed, limited, suspended, or discontinued.
We are not responsible for platform outages, data delays, data errors, AI errors, or third-party service interruptions. Third-party infrastructure outages, including hosting, authentication, database, payments, email, and market data provider outages, may affect access to the Service.
16. Limitation of Liability
To the maximum extent permitted by law, Hyper Stocks and its affiliates, officers, employees, contractors, service providers, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
We are not liable for trading losses, investment losses, missed opportunities, data errors, delayed data, AI errors, platform outages, loss of profits, loss of revenue, loss of data, or decisions made based on the Service.
Our total liability for any claim will not exceed the greater of:
(a) the amount you paid us in the twelve months before the claim; or
(b) US$100.
17. Indemnification
You agree to indemnify and hold harmless Hyper Stocks and its affiliates, officers, employees, contractors, service providers, and licensors from any claim, liability, damages, losses, or expenses, including reasonable attorneys’ fees, arising from your use of the Service, your breach of these Terms, your content, or your violation of any law or third-party right.
18. Termination and Suspension
We may suspend, restrict, or terminate your access to the Service at any time if we believe you violated these Terms, misused the Service, created legal or security risk, failed to pay required fees, shared your account, or used the Service in a manner inconsistent with its research and educational purpose.
You may stop using the Service at any time. Cancellation of a paid subscription is governed by the Subscription Terms and billing portal.
19. Dispute Resolution and Arbitration
Any dispute arising out of or related to these Terms or the Service will be resolved through binding, individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
You and Hyper Stocks waive the right to participate in class actions, class arbitrations, or representative proceedings to the maximum extent permitted by law.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Venue for any non-arbitrable dispute lies exclusively in the state or federal courts located in California, unless applicable law requires otherwise.
21. Changes to Terms
We may update these Terms from time to time.
Material changes may be communicated by email, in-product notice, or by requiring re-acceptance at your next login.
Continued use after the effective date constitutes acceptance of the updated Terms.
